1. Acceptance of Terms
By accessing or using the telehealth services provided by Mission MD (“Mission MD,” “we,” “us,” or “our”) through our website, mobile application, or other platforms (collectively, the “Platform”), you (“you” or “User”) agree to be bound by these Terms and Conditions (“Terms”). Please read these Terms carefully before using our services. If you do not agree to these Terms, you may not access or use the Platform or our services.
2. Description of Services
Mission MD provides telehealth services that connect you with healthcare professionals (“Providers”) for consultations, assessments, and other healthcare-related services. The specific services offered may vary and will be described on our Platform. Mission MD does not directly provide medical services; the Providers are independent professionals using our Platform to offer their services to you.
3. User Accounts
To access certain features of the Platform, you may be required to create a User account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information as necessary. You must be at least 18 years of age to use our services.
4. Program Types and Payment
Mission MD offers different types of programs:
- Fixed Length Programs: These programs have a predetermined duration of 18 or 24 months and may be offered with an upfront payment option.
- Variable Length Programs (Month-to-Month Subscriptions): These programs continue on a monthly basis until terminated by you or Mission MD.
5. Payment Terms
- Fixed Length Programs (Upfront Payment): If you choose the upfront payment option for a fixed length program, the total program fee is due at the time of enrollment.
- Fixed Length Programs (Monthly Payments): If offered, monthly payments for fixed length programs will be billed on a recurring basis according to the agreed-upon schedule. Your access to the Platform and services may be suspended or terminated if payments are not made on time.
- Variable Length Programs (Month-to-Month Subscriptions): You will be billed on a recurring monthly basis for these subscriptions. The billing cycle will typically commence on the date of your initial enrollment.
6. Cancellation Policy
- Variable Length Programs (Month-to-Month Subscriptions): You may cancel your month-to-month subscription at any time. To avoid being charged for the next billing cycle, you must cancel your subscription before the end of the current monthly term. Upon cancellation, your access to the Platform and services will cease at the end of the then-current billing cycle. No refunds or partial refunds will be provided for any unused portion of a monthly subscription.
- Fixed Length Programs: Due to the nature of our fixed length programs and the resources allocated upon enrollment, cancellations before the end of the program term are generally not permitted. However, we understand that unforeseen circumstances may arise. Requests for early cancellation of fixed length programs will be reviewed on a case-by-case basis. If an early cancellation is approved by Mission MD, any potential refund amount (if applicable) will be determined at our sole discretion, taking into account the services already provided and any administrative costs incurred. There is no guarantee of a refund for early cancellation of a fixed length program.
7. Termination by Mission MD
Mission MD reserves the right to suspend or terminate your access to the Platform and services at any time, with or without cause, including but not limited to:
- Your breach of these Terms.
- Non-payment of fees.
- Violation of applicable laws or regulations.
- Conduct that Mission MD deems harmful to other users or our business.
In the event of termination by Mission MD for reasons other than your breach of these Terms, we may, at our discretion, provide a pro-rata refund for any unused portion of a pre-paid fixed length program. No refunds will be provided for terminated month-to-month subscriptions.
8. Medical Disclaimers
- Not for Emergencies: Mission MD is not for medical emergencies. If you are experiencing a medical emergency, please call 911 or go to the nearest emergency room.
- Provider Independence: Providers using the Platform are independent professionals and are solely responsible for the medical advice and treatment they provide. Mission MD does not control or endorse any specific medical advice or treatment.
- No Guarantee of Outcome: Telehealth services may not be suitable for all medical conditions, and there is no guarantee of a particular outcome.
9. Intellectual Property
The Platform and its content, including but not limited to text, graphics, logos, and software, are the property of Mission MD or its licensors and are protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial use in accordance with these Terms.
10. Privacy Policy
Your privacy is important to us. Please review our Privacy Policy which explains how we collect, use, and disclose your personal information.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Mission MD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform or our services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the total amount paid by you to Mission MD in the twelve (12) months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Mission MD, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms or your use of the Platform.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in Boise, Idaho.
14. Changes to These Terms
Mission MD reserves the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our Platform or by other reasonable means. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.

Mobile Terms of Service

The MissionMD mobile message service (the “Service”) is operated by MissionMD (“MissionMD”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to MissionMD’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of MissionMD through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with MissionMD. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18668398982 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other MissionMD mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
